End User License Agreement (EULA)

1. Agreement to Terms

This End User License Agreement governs your access to and use of digital products, educational materials, videos, coaching or mentoring resources, community content, proprietary systems, trading frameworks, and other materials made available by Tommy Galvin LLC, including the MDR Sequence and related educational resources.

By purchasing, accessing, or using a Tommy Galvin LLC product or service, you agree to be bound by this Agreement.

If you do not agree to this Agreement, do not access or use the applicable products, materials, or services.

2. License Grant

Subject to your compliance with this Agreement and any applicable payment obligations, Tommy Galvin LLC grants you a limited, non-exclusive, non-transferable, non-sublicensable, and revocable license to access and use the products and materials made available to you solely for your personal, individual educational use.

This license gives you permission to use the materials only within the scope expressly authorized by Tommy Galvin LLC.

Purchasing or accessing our products or services does not transfer ownership of any intellectual property to you.

All intellectual property is owned by or licensed to Tommy Galvin LLC.

3. Authorized Access and Use

Digital content, videos, training materials, educational resources, and proprietary materials must be accessed through our authorized website, course platform, community platform, or other designated services.

You may download a resource only where Tommy Galvin LLC or the applicable authorized platform expressly provides or enables a download option.

Any permitted download remains subject to this Agreement and is provided solely for your personal educational use.

Except where expressly authorized, you may not:

• Download or extract protected video content
• Screen record or otherwise record protected content
• Circumvent technical access restrictions
• Copy or reproduce protected materials
• Mass download resources
• Repost or republish materials
• Distribute materials to third parties
• Upload paid materials to public or private file-sharing platforms
• Remove copyright, trademark, branding, watermark, or ownership notices
• Use technological means to scrape, extract, clone, or duplicate protected content

4. No Sharing of Access

Your account and access rights are for your personal use only.

You may not:

• Share login credentials
• Allow another person to use your account
• Sell, transfer, sublicense, rent, or lend your access
• Provide paid content or resources to unauthorized non-members
• Purchase access for the purpose of redistributing the materials

Unauthorized account sharing or distribution may constitute a material breach of this Agreement.

We may review reasonable account and access information for security purposes, fraud prevention, enforcement of this Agreement, and detection of unauthorized account sharing, consistent with our Privacy Policy.

5. Prohibited Conduct

You may not, without prior written permission from Tommy Galvin LLC:

• Distribute, resell, sublicense, or redistribute Tommy Galvin LLC materials
• Repackage or reproduce our training materials
• Publish paid educational materials publicly
• Share protected videos, recordings, documents, checklists, templates, or community resources with unauthorized third parties
• Record group coaching calls, private coaching sessions, mentoring sessions, or other restricted sessions without permission
• Use unauthorized copies or reproductions of Tommy Galvin LLC materials to create, market, or sell a competing educational product
• Represent Tommy Galvin LLC content, frameworks, branding, or materials as your own
• Remove or conceal copyright, trademark, branding, attribution, or ownership notices
• Use our content in a way that infringes our intellectual property rights or the rights of others

This section is intended to protect Tommy Galvin LLC’s proprietary expression, materials, recordings, branding, and other legally protected intellectual property.

Unauthorized reproduction or distribution of protected materials may result in suspension or termination of access and other remedies available under applicable law.

6. Suspension and Revocation of License

Tommy Galvin LLC may suspend or terminate your access, subject to applicable law and our Refund Policy, if you materially violate this Agreement.

Examples of material violations may include:

• Sharing login credentials
• Unauthorized distribution or reproduction of protected content
• Fraud or intentional misuse of the services
• Knowingly initiating a fraudulent or abusive payment dispute regarding a validly authorized charge
• Harassment, threats, or abusive conduct toward other community members or representatives of Tommy Galvin LLC
• Intentional disruption of the community
• Material violations of applicable community rules
• Attempts to circumvent access controls or security measures

Where permitted by applicable law, termination resulting from a material violation of this Agreement does not entitle the user to a refund.

Any outstanding payment obligations are governed by the applicable purchase terms, payment-plan terms, subscription terms, Refund Policy, and applicable law.

7. Intellectual Property Ownership

All content and materials made available through Tommy Galvin LLC products and services, including where applicable:

• The MDR Sequence
• Related trading frameworks
• Educational systems
• Recorded videos
• Coaching materials
• Written lessons
• Documents
• Checklists
• Templates
• Graphics
• Branding
• Community resources
• Proprietary educational materials

are owned by or licensed to Tommy Galvin LLC and may be protected by copyright, trademark, and other applicable intellectual property laws.

Your purchase grants access and limited usage rights only.

You do not acquire ownership of Tommy Galvin LLC intellectual property by purchasing, accessing, or participating in our products or services.

8. Educational Purposes / No Individualized Financial Advice

All content and services provided by Tommy Galvin LLC are intended for educational and informational purposes only.

Nothing provided through our website, products, services, coaching, mentoring, community, communications, examples, trade breakdowns, or educational materials constitutes individualized investment, financial, tax, or legal advice.

Tommy Galvin LLC does not manage customer brokerage accounts, execute trades on behalf of customers, or exercise discretionary trading authority over customer funds or brokerage accounts.

You remain solely responsible for evaluating information and making your own trading and financial decisions.

9. No Guarantee of Results

Futures trading involves substantial risk of loss and is not suitable for everyone.

Trading results vary significantly between individuals, and past performance is not indicative of future results.

Tommy Galvin LLC does not guarantee trading profits, income, payouts, account growth, profitability, or any other financial result.

Losses may be significant and, depending on the circumstances, may exceed the amount initially committed to a position.

No trading strategy, educational system, coaching program, mentoring relationship, course, framework, level of effort, or level of participation can guarantee profitability or prevent losses.

10. Limitation of Liability

To the fullest extent permitted by applicable law, Tommy Galvin LLC and its owner, affiliates, contractors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or related to your access to or use of our products, services, educational materials, or community.

Tommy Galvin LLC is not responsible for trading losses, lost profits, missed trading opportunities, market movements, brokerage activity, or financial decisions made by users.

No specific trading result, financial outcome, income level, payout, or return on investment is guaranteed.

To the fullest extent permitted by applicable law, the aggregate liability of Tommy Galvin LLC arising from a particular product or service will not exceed the amount actually paid by the applicable customer to Tommy Galvin LLC for the product or service giving rise to the claim.

Nothing in this Agreement excludes or limits liability to the extent such liability cannot lawfully be excluded or limited.

11. Payment Obligations

If you purchase a fixed-price product or service using an installment payment plan, you remain responsible for completing the agreed-upon installment payments, subject to applicable law and the applicable payment terms.

Suspension or termination of access due to non-payment does not automatically eliminate amounts already owed under a valid fixed-price installment payment plan.

If you purchase a recurring subscription or membership, future renewals and cancellation are governed by the subscription and cancellation terms disclosed at the time of purchase.

Cancellation of a recurring subscription stops applicable future renewals after the cancellation becomes effective but does not automatically create a right to a refund for charges already incurred, except where required by applicable law or expressly stated in the Refund Policy.

12. Governing Law

This Agreement is governed by and construed in accordance with the laws of the State of Florida, United States, without regard to conflict-of-law principles, except where applicable mandatory law provides otherwise.

Subject to any rights or protections that cannot legally be waived, disputes arising from or relating to this Agreement will be handled in accordance with applicable law and, where legally permitted, within the appropriate courts located in Florida.
